Litigants may face situations where they receive judgment in their favor in a given jurisdiction (e.g. a US State or the Federal Court, or a Canadian Province), but are unable to collect on the judgment in said jurisdiction due to the debtor’s lack of assets there. However, the debtor may have assets elsewhere, and the creditor will want to collect on such assets in order to satisfy the judgment. The first step towards such enforcement is to have the original judgment recognized in the jurisdiction where the assets are located. The proceeding to enforce a foreign judgment in another jurisdiction is quite complex and requires a deep understanding of both legal systems involved manifested, among other things, in a legal opinion regarding the legal process in the original jurisdiction.
MVC represents clients who need to enforce in Israel judgments rendered in all US and Canadian jurisdictions or those who wish to defend against such motion to recognize and enforce a foreign judgment. MVC provides such clients full representation in court including the mandatory legal opinion based on appropriate arguments. When the foreign jurisdiction is in the US, Eddy Meiri from the MVC team will provide the legal opinion. In other cases MVC will address the proper legal expert according to the jurisdiction involved to receive such legal opinion.
